Services
Scope of Standard Services: Standard pool maintenance services are limited to routine cleaning, basic water testing, and general visual inspection only.
Our standard services may include, but are not limited to:
- Regular pool cleaning and debris removal
- Basic water testing and chemical recommendations/dosing at our discretion
- Skimmer and pump basket cleaning
- Tile and surface brushing (where safe and accessible)
- General visual inspection of equipment (non-technical)
Excluded from Standard Services
Services do not include green pool recoveries, black spot treatment, acid washing, storm or flood damage cleanup, equipment installation, plumbing, electrical work, leak detection, structural repairs, or manufacturer warranty claims unless quoted separately in writing.
Chemicals, Water Quality & Results
No guarantees are made regarding water clarity, algae prevention, sanitation levels, or chemical outcomes. Results are affected by factors outside our control including weather, bather load, equipment condition, water source, and customer actions. Chemical usage, dosage, and effectiveness may vary at our discretion.
Chemicals supplied will be charged separately unless expressly included in the customer's service plan.
Additional services may be requested and will be quoted separately in writing.
Scheduling & Access
Scheduling: Service days and times may vary based on route and operational requirements. Aussie Pool Man may reschedule, substitute, or vary services where permitted by law.
Access, Safety & Completion of Service: Customers must provide safe, clear, and unrestricted access to the pool and all equipment, including unlocked gates, working power supply, sufficient water levels, and a safe working environment.
If access is unavailable, unsafe, obstructed, or if pets, power, water, or safe conditions are not present, the service may be deemed completed and charged in full. Aussie Pool Man may refuse or cease service immediately where safety risks exist.
Pet Safety: Please secure all pets during scheduled service times. Service will not be performed if unsecured pets are present.
Payment Terms
Pricing & GST
All prices are in Australian Dollars (AUD) and include GST unless otherwise stated.
Invoices
Invoices are issued after the service/work is completed, unless otherwise agreed in writing. Payment is due within the stated payment terms on the invoice.
Deposits
For certain jobs or larger works, customers may be required to pay a 50% deposit before work is completed. Any deposit requirements will be communicated before work proceeds.
Payment Methods
Online payment is encouraged and preferred. Cash may not be accepted unless agreed to prior. Automatic payment setup is not provided.
Overdue Accounts
Services may be suspended for overdue accounts. Late payments may incur reasonable administrative or interest charges as permitted under Australian Consumer Law.
Debt Recovery
Accounts unpaid after 30 days may be referred to a third-party debt collection agency or subject to reasonable legal recovery action. All reasonable recovery costs, including debt collection fees, legal fees, and administrative costs, are payable by the customer to the extent permitted by law.
Chemicals
Chemicals supplied will be charged separately unless expressly included in the customer's service plan.
Cancellation Policy
Permanent Cancellations: Customers may cancel ongoing or full service arrangements at any time. No minimum notice period is required for permanent cancellations.
Same-Day Cancellations & Missed Services: Same-day cancellations, missed services, or situations where service cannot be completed due to access issues, safety concerns, locked gates, pets, lack of power, insufficient water levels, or other site-related issues may be charged at the full service rate.
Temporary Pauses: Temporary pauses or suspensions of service do not suspend, waive, or cancel any outstanding or previously issued invoices, unless expressly agreed in writing by Aussie Pool Man.
Weather: Services may be rescheduled due to inclement weather or unsafe working conditions at our discretion.
Liability & Warranty
Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any consumer guarantees or rights under the Australian Consumer Law that cannot be excluded by law.
Purchase of Chlorinator – Possible Rusting of Pool Structure
Aussie Pool Man expressly discloses, and the client acknowledges having received prior notice, that in some instances chlorinators and associated pool equipment may contribute to rusting, corrosion, or deterioration of pool structures or surrounding components.
The client acknowledges that any such rusting or corrosion may occur for reasons entirely beyond the control of Aussie Pool Man, including but not limited to environmental factors, pool construction materials, historical water balance, salt exposure, electrical conditions, or pre-existing structural issues.
The purchase and/or installation of any chlorinator is made by the client on the express understanding that Aussie Pool Man will not be responsible for any rusting, corrosion, damage, or deterioration of the pool structure or related components that may subsequently occur. The client releases and indemnifies Aussie Pool Man from any loss, damage, cost, or claim arising out of or in connection with rusting or corrosion allegedly caused by the chlorinator or its operation, to the maximum extent permitted by law.
Goods, Risk & Ownership
Risk: Risk in all goods supplied passes to the client when goods are delivered to the client.
Ownership: Ownership of all goods supplied remains with Aussie Pool Man until payment is made in full for the goods. Until payment is made, the client holds all goods as fiduciary bailee.
Service Satisfaction (Repeat Service)
If the client is not satisfied with a service performed by Aussie Pool Man and notifies Aussie Pool Man within 7 days of the service being performed, Aussie Pool Man may, at its discretion, repeat the service at no additional cost. This does not apply where the outcome is affected by factors outside our control, including water conditions, equipment failure, weather, access issues, or pre-existing conditions.
Definitions
- Conditions means these Terms & Conditions, including any amendment or variation.
- Goods means any goods supplied by Aussie Pool Man to the client, including pool equipment, chlorinators, salt cells, pumps, filters, and accessories.
- Aussie Pool Man includes Aussie Pool Man, its owners, contractors, agents, and authorised representatives.
Equipment, Salt Cells & Pre-existing Conditions: Aussie Pool Man is not responsible for the condition, performance, failure, or reduced lifespan of existing pool equipment, including pumps, filters, heaters, chlorinators, salt cells, plumbing, or electrical components. No responsibility is accepted for issues caused by age, wear, corrosion, manufacturer defects, prior servicing, poor historical water balance, or pre-existing conditions.
Limitation of Liability: To the maximum extent permitted by law, Aussie Pool Man's liability for any claim arising from the provision of services is limited to the total amount paid by the customer in the preceding three (3) months.
Aussie Pool Man is not liable for indirect, incidental, or consequential loss, including loss of pool use, water loss, chemical damage, equipment downtime, or third-party actions.
Customer Responsibilities
To ensure optimal service delivery, customers agree to:
- 1Maintain proper water levels (mid skimmer line) at all times
- 2Ensure working power supply is available for pool equipment
- 3Report equipment malfunctions or unusual pool conditions promptly
- 4Keep the pool area safe, accessible, and free from hazards
- 5Secure all pets during scheduled service times
- 6Not drain the pool without prior consultation with Aussie Pool Man
- 7Notify us of any changes to pool usage, renovations, or special events
- 8Provide and maintain working electrical connections for all pool equipment
Dispute Resolution
We value our customer relationships and are committed to resolving any concerns quickly and fairly.
Informal Resolution: Please contact us directly to discuss any service concerns. Most issues can be resolved through open communication.
Governing Law: These Terms & Conditions are governed by the laws of Queensland, Australia. Any disputes not resolved informally will be subject to the exclusive jurisdiction of the courts of Queensland.
Continued use of Aussie Pool Man services constitutes acceptance of these Terms & Conditions, including any updates made without prior notice where permitted by law.
Modifications to Terms
Business Discretion & Changes Without Notice: Aussie Pool Man reserves the right to modify, suspend, reschedule, substitute, vary, or discontinue any service, pricing, service frequency, route, technician, chemical usage, method of service, or operational process at any time and without prior notice, where permitted by law.
Changes may take effect immediately upon publication on our website or application to future services. Continued use of our services constitutes acceptance of such changes.
Updated terms will apply to services provided after the effective date stated in any notice (where required). If you do not agree to updated terms, you may request cancellation in writing.
For clarity, the most current version of these Terms & Conditions will be available on our website. Where there is any inconsistency between older versions and the current published version, the current published version will prevail to the extent permitted by law.
